In the course of your interaction with Biond and your use of our website at http://biondbio.com/ (the “Website”), you may provide us with certain personal information which may identify you directly or when associated with other information (“Personal Information“). This privacy policy (“Policy“) describes what information we collect and why we collect it; how we use it and your rights with regard to the collection and use of your Personal Information. This Privacy Policy does not apply to Personal Information collected in connection with clinical trials.

This Policy pertains to information gathered through your interactions with Biond (including as a vendor, service provider, partner or in the course of any other business transaction, sales and support), our Website, and any communication with Biond through any channel, including telephone, email, SMS, WhatsApp, social networks, in person and the like. This includes applying for a job at Biond or following us on social media. Some information may be automatically collected, as further detailed below.

Please note that there is no legal obligation to provide us with your Personal Information, unless explicitly stated otherwise. However, declining to provide certain information, or the failure to provide complete information, may prevent Biond from providing you with the requested information or services, or entering a contract with you. The provision of information, including by means of continued browsing of our Website or interacting with us through other channels, constitutes consent to the processing of such information in accordance with this Privacy Policy. If you do not agree to the terms set forth herein, you must immediately cease all use of the Services.

In the course of your engagement with Biond, you may be requested to provide various categories and types of Personal Information. This may include, but is not limited to:

2.1. Personal Information provided by you:

• Contact Details: your name, age, addresses, telephone numbers, personal email addresses, postal address or other identifier by which you may be contacted online or offline.
• User communications: When you send an email or other communication to us, we may retain those communications and other information you may choose to provide to Biond, in order to process your inquiries, address complaints, respond to your requests and improve our services, among other purposes as described below. Biond may share this data across Biond group companies and affiliates to optimize its services.
• Medical Data: If you contact us to enquire about clinical trials, we may collect information regarding your health conditions, including, but not limited to, age, gender, weight, height, medical history, symptoms, diagnosis, as necessary to respond to your query with information relevant to your situation, among other purposes, as described below.
• Job Application. Should you apply for a position at Biond, we may request the following information: contact information, address, Curriculum Vitae (resumé) information (including information such as skills, work experience, education), notes submitted with the application, the position for which you have been or are being considered, email and other correspondences in connection with your candidacy, information from references, information about your candidacy and employment options, materials you or other parties (such as evaluators or background check providers) submitted in relation to your candidacy, and any documents required to fulfill legal obligations related to your job application. We use your Personal Information to evaluate and consider you as a candidate for positions, in accordance with our processes and policies for evaluating employment candidates, to contact you for your candidacy status and interviews, to schedule meetings and interviews, among other purposes, as described below. We may share your information with various third parties under the following circumstances and only for the purposes detailed above: (1) where it is required by law, e.g. by judicial order; (2) to service providers and its consultants e.g. software and hosting providers, recruiters, background checks; (3) where you have explicitly consented to such transfer. Biond may also retain your personal information for a period of up to two years and contact you to inform you of additional positions that may be of interest to you. • Other Business-related Information: Biond may collect various types of Personal Information from its business partners, including vendors and service providers. This may include identification and contact details, professional and employment information, financial and payment data, communication records, transactional details, and legal or compliance-related information. In such cases, the service provider is responsible for informing its representatives/employees as to the collection and provision of their information and its processing by Biond, and for obtaining their consent thereto prior to providing such information to Biond. This information is collected for purposes such as managing business relationships, processing payments, ensuring legal compliance, and facilitating effective communication with its business partners, among other purposes, as described below.

2.2. Personal Information collected automatically:

When you engage with Biond digitally, we may obtain additional information related to you. This could entail data automatically transmitted to us during the interaction between your device and our servers, such as Internet Protocol (IP) addresses, browser, URLs, operating system and device identifiers, browser plug-in types and versions, screen resolution, Flash version, time zone settings, language preferences, location, information about the manner and time in which you make use of the Website, content preferences and other technical and/or statistical information that may not personally identify you. Biond may compile statistical and aggregated information from users of our digital platforms using various technologies and is entitled to transfer this information to third parties, including advertisers. Statistical and aggregated information will not personally identify you. 

2.3. Data collection technologies on the Website:

When you access or use our Website, we may use industry standard technologies such as cookies, pixels, tags, clear GIFS, scripts or other similar technologies (hereinafter collectively “cookies”). Cookies are text files stored on the user’s device and used to record and retain data specific to a web application (such as preferences selected and movement within the application). These files may remain on your device in order to be activated upon your subsequent visits to the Website.

Cookies collect and analyze data regarding your use of the Website, for the purposes set out below.  We utilize cookies to understand how visitors interact with our Website and to better serve you with more tailored information, and to facilitate efficient and secure access to our services. We may also use the information collected by cookies in connection with Website pages and HTML formatted email messages to, among other things, track the actions of users and email recipients and compile statistics about usage and response rates. Our cookies do not, by themselves, contain Personal Information. Further, we do not combine the general information collected through cookies with any other Personal Information to identify you. The following are the types of cookies used on our Website:

• Essential cookies. Used for the ongoing operation and to ensure the proper functioning and security of the Website. These Cookies do not collect information that may identify you or information that can be associated with you (targeting).
• Performance and statistics cookies. We use Google Analytics, a third-party cookie, to monitor activity on the Website with the aim of analyzing, evaluating, and improving its performance. They enable the Website to understand how visitors use the various pages, how much time they spend on the Website, the frequency of use of the Website and the referring URL, as well as to derive insights that enable us to maintain, measure, and improve our marketing, advertising, and sales activities. The information collected is anonymous, meaning it does not identify website users and is not cross-referenced with other information held about users. Any collection and processing of information by the Google Analytics cookie for purposes other than Biond’s are governed by Google Analytics’ Terms of Service, which can be found at this link and by Google’s Privacy Policy, which can be found at this link. In addition to the methods mentioned above to prevent the creation of cookies during your use of the Website, you may at any time prevent the collection of your information by Google Analytics by downloading and installing the Google Analytics Opt-out Browser Add-on, available at this link.
• Operational cookies. Used to remember the settings and choices made by the User, with the aim of improving the user experience. These Cookies enable, among other things, the retention of the interface language, design settings, login details, and the operation of essential functions on the Website.
• Marketing and advertising cookies. Used to display advertisements and content tailored to your areas of interest, including on websites and services of third parties, based on your browsing and usage history on the internet. For this purpose as well, we embed Third-party Cookies such as social media platform Cookies and Google Ads.

3.1. Performance of a Contract with You or Where We Have Your Consent.

We require your Personal Information for various activities essential to the performance of our engagement with you or for steps preceding the establishment of such engagement, such as processing inquiries, addressing complaints and responding to requests.

If you reside or interact with Biond from a jurisdiction where privacy laws mandate consent as the sole legal basis for processing Personal Information, by providing us with your information, you automatically consent to its processing for all purposes outlined in this Policy.

3.2. Legitimate Interests.

Legitimate Interests include the following:

1. Ensuring a secure environment, encompassing fraud prevention, data security, addressing technical issues, and safeguarding the rights and properties of Biond and our partners including by providing proper notices, pursuing available legal remedies, and acting to limit our damages. This involves verifying and authenticating your identity, preventing unauthorized or illegal activity and taking action against activities that may breach our Terms of Use (available here), any other applicable services agreement we have with you or applicable law.
2. Undertaking legal actions, including the establishment, exercise, or defense of legal claims and to pursue available remedies or limit the damages that we may sustain.
3. Developing and enhancing our services and Website, including by conducting research and analysis using your information, which may be subject to your separate written authorization.
4. Managing business relationships with Biond’s partners.
5. Ensuring compliance with internal policies and procedures.

3.3 Legal obligations.

We may process your Personal Information to fulfill legal obligations. This includes situations where we are required by law to collect, use, or disclose your information, such as complying with regulatory mandates and court orders, cooperating with judicial proceedings, and responding to lawful requests from public and government authorities. Rest assured that we only process your Personal Information to the extent necessary to fulfill legal obligations and protect the rights, safety, and security of our customers, employees, our company, and the public. Additionally, we may process your Personal Information to enforce our Terms of Use, investigate potential violations, or address fraud or security issues.

We will not share your Personal Information with third parties, except in the following instances:

1. When we have received your permission. This includes sharing information as described in this Policy or otherwise with other third-parties when you have specifically authorized us to do so.
2. With our affiliates. This relates to entities that are legally part of the same group of entities that are connected to Biond, or that become part of that group.
3. As a response to a legal request (such as a court order, search warrant or subpoena) if (i) we believe that we are required to do so by any applicable law; or (ii) when we believe that such disclosure or use is necessary in order to reveal, prevent and address fraud and other illegal activities; enforce this Policy, including in order to investigate potential breaches thereof; protect our rights, property or safety, or those of our customers, employees or the public from harm, as required or permitted by applicable law; and prevent death or imminent bodily harm.
4. When we engage third parties to process Personal Information on our behalf, including to facilitate our services or any portion thereof, such as marketing, data management or maintenance services (including IT and other support services) and for analytics services. Such analytics service providers set their own cookies or other identifiers on your computer, through which they can collect information about your usage of our Website. This helps us compile aggregated statistics about the effectiveness of our Website and services.
   Such third-party service providers may operate in countries different from your own, and we may transmit information we receive to them. When these third-party service providers process your Personal Information on our behalf, we will ensure that they adhere to obligations similar to those outlined in this Policy. Additionally, we will ensure that they comply with our data privacy and security standards and only use the Personal Information for the purposes specified by us. We will transfer your Personal Information using appropriate safeguards and a range of legal mechanisms, including contracts, to ensure your rights.
5. If we become involved in a merger, acquisition, or any form of sale of some or all of our assets or in the event of our reorganization, corporate division or other fundamental corporate changes, you will be notified on a best efforts basis via email and/or a prominent notice on our Website, of any change in ownership, uses of your Personal Information, and choices you may have regarding your Personal Information. In any of the circumstances above, your Personal Information will continue to be used in accordance with this Policy.
6. Non-Personally Identifiable Information. We may also share data collected, as described in the “Personal Information We Collect” section, in an aggregated or non-personally identifiable form. This means the information shared will not include details that could identify you personally.

If you reside in, or are interacting with us from, the European Union, you should know that most of the processing of your Personal Information takes place in the territory of the State of Israel, which is recognized by the EU Commission as providing adequate protection to your Personal Information. Notwithstanding the above, we may transfer, process and store your Personal Information also in territories which have yet to be recognized by the EU Commission as providing adequate protection to your Personal Information. However, we will take reasonable measures to ensure your Personal Information is protected in such cases. 

Generally, Biond does not retain information beyond what is necessary for the purposes for which it was collected (such as providing services and fulfilling its legitimate business and legal requirements). Some Personal Information will be deleted automatically – e.g. if it is no longer required for the fulfillment of the purpose for which it has been collected or Personal Information that is no longer relevant – and some Personal Information will be deleted upon your request – e.g. Personal Information that you directly provided to us and wish to erase, unless the data is required for Biond to establish, exercise or defend against legal claims and/or otherwise required by law to be retained. Certain regulatory, legal or organizational requirements may require the retention of specific Personal Information for specific periods of time. This includes, among others:

• Personal Information which is required to prevent fraud or abuse;
• Personal Information which is required for our internal security purposes;
• Personal Information which needs to be retained to meet any audit requirement, for bookkeeping and accounting purposes, in order to comply with legal or regulatory requirements or to exercise any legal right.

We will retain the minimum Personal Information required for those purposes.

Likewise, some metadata and statistical information are not subject to the deletion procedures in this Policy and may be retained by Biond. We will not be able to identify you from this data. Some data may also be retained on our third-party service providers’ servers until deleted in accordance with their privacy policy and their retention policy.

According to applicable data protection laws and regulations, you may have the following rights:

• The right to access your Personal Information that is held by us;
• The right to rectify inaccurate Personal Information regarding you;
• The right to have your Personal Information deleted from our systems. Please note that we use backup systems in which your data is stored without the ability to delete it immediately upon request. Therefore, we may require an additional short period of time until we are able to fully delete all traces of your Personal Information. Nonetheless, for legal reasons, organizational reasons or in order to prevent fraud, we may retain certain specific information relating to you. In any event, your request for deletion will be recorded and the request itself will not be deleted.
• The right to restrict or object to the processing of your Personal Information;
• The right to receive your Personal Information in a generally useable, machine-readable, and standardized format.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to an unauthorized recipient.

You also have a right to appeal (as far as this affects you) to the respective Data Protection Supervisory Authority.

We do not charge for complying with a correction request, however, for all other requests, we may charge a small fee to cover its costs. We may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical, or for which access is not otherwise required.

We follow generally accepted industry standards to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of Personal Information. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

We have physical, electronic, and procedural security measures and safeguards to reasonably protect Personal Information. Our servers and our databases are protected by industry standard security technology. We endeavor to restrict access to Personal Information about you to employees, contractors and service providers who we believe reasonably need to come into contact with that Personal Information.

Although we cannot guarantee against any loss, misuse, unauthorized disclosure, alteration or destruction of data, we try to prevent such unfortunate occurrences, including by implementing corporate procedures in this regard. If you have reason to believe that your Personal Information is no longer secure, please immediately notify us of the problem by contacting us in accordance with the “Contacting Us” section below.

We may also send you newsletters and promotional communications if you joined our mailing list. You may withdraw your consent and opt-out of this service at any time by clicking UNSUBSCRIBE at the bottom of each email or by submitting a request to info@biondbio.com.

Your interaction with Biond may contain integration with third-party services and links to third party sites or other apps or services that are not owned or operated by Biond.

Similarly, it is possible that you will use other services to interact or interface with our platforms (e.g. interacting with us via your social network account). This Policy only applies to Biond’s processing activities and does not apply to any third party sites, apps, platforms or any other services. We are not responsible for the privacy practices or terms of such other third parties even if our name and logo appear on the screen. We recommend that you review the privacy policies of such third parties before you use any apps or services they offer.

We do not knowingly gather or retain Personal Information from individuals under the age of 18. If you are under 18 years old, you must not provide us with Personal Information unless you have obtained consent from your parent or guardian and have informed us of your age beforehand.
